1. NO PURCHASE NECESSARY

This raffle is a free promotional sweepstakes conducted by Tortora Promotions (“Organizer”). No payment, purchase, or monetary consideration is required to enter or participate. Entry is open to individuals who meet the eligibility requirements below.

Participation in this raffle constitutes full and unconditional agreement to these Terms and Conditions.

 

2. ELIGIBILITY

• The raffle is open to legal residents of the United States who are 18 years of age or older at the time of entry.

• Employees, affiliates, and immediate family members of Tortora Promotions or any participating sponsors are not eligible to win.

• Void where prohibited by law.

 

3. HOW TO ENTER

To enter the raffle:

1. Follow each sponsor account listed on the official Tortora Promotions raffle roster on Instagram.

2. Complete and submit the official Terms & Conditions acknowledgment form.

3. Participants must follow the Instagram account of each raffle sponsor to be entered to win and must be following each account at the time of drawing. Proof of account following will be checked upon raffle sign up to be fully entered into raffle and will count as 1 entry

   1. Following each one of the guidelines above constitutes an official entry into the sweepstakes and participants must be 18 years old or older to enter.

4. (Optional) For additional entries: Post a photo on your Instagram Story tagging all participating sponsor accounts. Each correctly tagged story counts as five (5) total entries instead of one. Photo must be taken at Tortora Promotions booth and mentioned during sign up process below.

Failure to complete all required steps will result in disqualification from the drawing.

 

4. ENTRY LIMITS

Participants may enter only as permitted under the rules above. Multiple entries that violate these terms, or use fake, duplicate, or bot accounts, may result in disqualification at the discretion of Tortora Promotions.

 

5. RAFFLE DRAWING

• Winners will be drawn on Tuesday, October 14, 2025 by Tortora Promotions and/or affiliates

• The drawing will be conducted fairly and randomly.

• Entry into the raffle does not guarantee winning.

• Winners will be notified directly via Instagram Direct Message from Tortora Promotions’ official account.

 

6. PRIZES AND SPONSOR PARTICIPATION

• Each winner will receive a mystery prize provided by one of the participating sponsors.

• Winners cannot select which sponsor or mystery prize they will receive.

• The specific prize and value vary by sponsor and are subject to availability at the discretion or each sponsor.

• Participants are not entitled to any compensation, cash value, or prize. Sweepstakes winners are eligible for mystery prize from associated sponsor. Prizes vary per sponsor and have no cash value and cannot be exchanged, transferred, or substituted for monetary compensation or other items.

• Some sponsors may contribute a prize item; others may participate solely as event sponsors.

  • Being listed as a sponsor does not guarantee a prize contribution.

7. CLAIMING PRIZES

• Winners must show proof of Instagram account ownership matching the account drawn to claim their prize. Verification of account ownership method varies per sponsor and failure to authenticate account ownership means participant will not be entitled to sweepstakes prize.

• Winners must contact the assigned sponsor directly to arrange prize pickup and obtain details.

• Prizes must be claimed within 30 calendar days of notification.

• Failure to claim within 30 days results in forfeiture of the prize, and the winner forfeits any and all rights to the prize or compensation.

• If a prize requires delivery, the winner is solely responsible for all delivery, shipping, or transportation costs. Delivery and shipping availability varies by sponsor and may not be available in all locations.

• Any costs associated with third-party delivery or shipment are not the responsibility of Tortora Promotions or any event sponsor and are considered a direct expense of the sweepstakes winner.

• The winner is responsible for arranging the pickup, shipping, or removal of the mystery prize from the sponsor’s location within 30 calendar days of notification. Failure to do so will result in forfeiture of the prize, and no substitutions or cash equivalents will be provided.

• Additionally, any travel or transportation expenses incurred to claim or retrieve the prize are the full responsibility of the winner and will not be reimbursed by Tortora Promotions or any sponsor.

• Delivery or fulfillment of any item is not guaranteed and depends on sponsor availability.

 

8. TRANSFER AND REDEMPTION RESTRICTIONS

Winners may not sell, exchange, transfer, or give away their winning status, placement, or prize. Sweepstakes winners cannot choose their prize. Mystery prize is at the discretion of the raffle sponsor who is offering a mystery prize. Not all sponsors offer a mystery prize and are not required to do so.
Only the individual whose Instagram handle was selected is eligible to claim the prize.

 

9. LIABILITY & LEGAL RELEASE

By entering the raffle, participants agree to fully release, indemnify, and hold harmless:

• Tortora Promotions,

• All event sponsors,

• The third-party drawing entity, and

• All their respective owners, affiliates, partners, employees, and representatives

from any and all claims, damages, losses, liabilities, injuries, or expenses arising out of:

• Participation in the raffle;

• The selection process;

• The delivery, receipt, acceptance, or use of any prize; or

• Any issues, delays, or disputes with sponsors regarding prize availability or fulfillment.

Tortora Promotions assumes no responsibility or liability for:

• Late, lost, incomplete, misdirected, or inaccurate entries;

• Technical errors;

• Sponsor failure to provide a prize;

• Issues in communication between winners and sponsors; or

• Any circumstances beyond its reasonable control.

 

LEGAL DISCLAIMER

This raffle is a promotional sweepstakes, not a paid contest. No purchase or payment of any kind is necessary to enter or win. Entry and participation imply acceptance of these official rules. All participants agree that Tortora Promotions and all event sponsors are not legally liable for any damages, claims, or losses resulting from participation or prize redemption.

 

Legalities & Liability

• Limitation of Liability
  Tortora Promotions LLC (“Organizer”) shall not be held liable to any participant, sponsor, or third party for any direct, indirect, incidental, consequential, or special damages arising out of or relating to participation in this sweepstakes or use of its promotional services.

• Indemnification
  Each participant or sponsor, agrees to indemnify, defend, and hold harmless Tortora Promotions LLC, its owners, affiliates, contractors, employees, and representatives from and against any and all claims, liabilities, damages, losses, expenses, or legal actions (including reasonable attorney fees) arising from or related to:

  • Participation in the sweepstakes,

  • Any promotional activity including but not limited to social media management, videography, photography, content creation, or event coverage,

  • Any use, misuse, or inability to use materials, content, or promotional deliverables provided by Tortora Promotions.

 

The participant and/or client assumes full responsibility for all actions and consequences related to their involvement and agrees to release Tortora Promotions from any and all potential legal or financial liabilities.

Arbitration Agreement

• This agreement and all disputes arising under or related to it shall be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

• Any dispute, controversy, or claim arising out of or relating to this agreement or the sweepstakes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

• Judgment upon any arbitration award may be entered in any court having jurisdiction.

• The arbitration shall be conducted in the English language in Hudson County, New Jersey.

• Arbitration shall be conducted by a panel of three (3) arbitrators appointed in accordance with the AAA’s rules and procedures.

 

By entering this sweepstakes, all participants and sponsors expressly waive the right to a jury trial or participation in any class action, and agree that arbitration shall be the exclusive method of resolving disputes.

 

10. PUBLICITY RELEASE

By entering the raffle, participants consent to the use of their name, Instagram handle, likeness, photos/image, and entry information for promotional purposes by Tortora Promotions and event sponsors without further compensation, except where prohibited by law. Famous Food Festival and Affiliates are not a part of Sweepstakes giveaway.

 

11. MISCELLANEOUS

• Tortora Promotions reserves the right to modify, suspend, or cancel the raffle at any time for any reason, including technical malfunctions, fraud, or other issues beyond its control.

• The raffle is subject to all applicable federal, state, and local laws and regulations.

• These Terms & Conditions constitute the entire agreement governing the raffle and supersede all prior communications or understandings.

 

12. EVENT DETAILS

• Main raffle drawing for all mystery items: Tuesday, October 14, 2025.

• Additional mini raffles may occur during the Famous Food Festival Event, announced live and on social media.

Electronic Record and Signature Disclosure

By completing the sweepstakes entry process and following all participation instructions, each participant affirms that they have read, understood, and agree to these Terms and Conditions, including this Electronic Record and Signature Disclosure.

By providing your electronic signature or submitting your information online, you consent to the use of electronic records and digital signatures as legally binding equivalents of physical documents and handwritten signatures.

By signing or submitting electronically, you confirm that you:

• Have reviewed and accepted all sweepstakes Terms and Conditions, and

• Consent to the use of electronic communications and records in lieu of paper-based documents.
